These Terms and Conditions (the “Terms”) are between Elowynthia Inc. (“Elowynthia,” “we,” “us,” “our”), organized under the laws of the State of California, United States of America, and you (“you,” “User”) accessing/using our lightweight tool application (the “Application”).

By accessing, downloading, or using the Application, you agree to these Terms and our Privacy Policy (available at [Privacy Policy URL], if applicable). If you disagree, do not use the Application. These Terms are a binding agreement governing your use of the Application.

1. Acceptance of Terms

Your use of the Application constitutes full acceptance of these Terms and any updates (see Section 11). We may require explicit acceptance (e.g., checking a box) for certain features, and continued use after updates confirms your acceptance.

You warrant you have legal capacity to enter these Terms. The minimum age of 13 (or applicable local law) complies with global privacy regulations (e.g., COPPA, China’s Minor Internet Protection Regulations) to protect minors’ data, even for our lightweight tool. If using on behalf of an entity, you warrant authority to bind it.

2. Grant of License

Elowynthia grants you a limited, non-exclusive, non-transferable, revocable license to use the Application for personal/non-commercial use (or commercial use if permitted), per these Terms and law. You may not:

• (a) Modify, copy, distribute, decompile, reverse engineer, or disassemble the Application;

• (b) Use the Application for illegal/unauthorized purposes;

• (c) Sublicense, rent, lease, or transfer access to third parties;

• (d) Use the Application to violate Elowynthia’s or third parties’ rights.

 

3. User Obligations

When using the Application, you agree to:

• (a) Comply with all applicable laws and regulations;

• (b) Use the Application only for its intended lightweight tool purpose, not harmful/fraudulent activity;

• (c) Keep account credentials confidential and take responsibility for account activity;

• (d) Notify us immediately of unauthorized account use or security breaches;

• (e) Not upload illegal, offensive, defamatory, or harmful content;

• (f) Not interfere with or disrupt the Application or its connected servers/networks.

 

4. Application Use and Restrictions

The Application is provided as a lightweight tool without guarantees of error-free, uninterrupted use or universal device compatibility. You may not:

• (a) Use automated tools (e.g., bots, scrapers) to access/interact with the Application;

• (b) Overload, crash, or damage the Application or its infrastructure;

• (c) Bypass security measures or access controls;

• (d) Use the Application to collect/harvest other users’ personal information.

 

5. Intellectual Property Rights

All intellectual property in the Application (software, code, logos, trademarks, etc.) belongs to Elowynthia or its licensors. No rights are transferred to you, and you may not use our intellectual property without written permission.

Any feedback/suggestions about the Application become Elowynthia’s exclusive property, usable without obligation or compensation to you.

 

6. Disclaimers and Limitation of Liability

6.1 Disclaimers

The Application is provided “as is” and “as available” without any warranties (express or implied), including merchantability, fitness for purpose, non-infringement, or reliability. We do not warrant it will meet your needs, be uninterrupted/error-free, or that defects will be corrected.

6.2 Limitation of Liability

To the maximum extent permitted by law, Elowynthia is not liable for direct, indirect, incidental, consequential, or special damages arising from your use of the Application, even if advised of such risk. Total liability shall not exceed $50 or the amount you paid (if any) for access.

 

7. Termination

These Terms remain in effect until terminated. We may terminate your access without notice for Terms violations, ceasing service, or other discretion. Upon termination, your license ends, and you must stop using the Application. Sections 5, 6, 8, 9, and 11 survive termination.

You may terminate by uninstalling the Application and ceasing use. Termination does not relieve you of prior obligations.

 

8. Data Privacy

Your use is subject to our Privacy Policy, which governs personal information collection/use. By using the Application, you consent to our data practices; review the Privacy Policy for details.

 

9. Third-Party Services

The Application may link to third-party services. Elowynthia does not control or endorse them; your use is subject to third parties’ terms, and we are not liable for related damages.

 

10. Changes to These Terms

We may update these Terms for legal or service changes. Material changes will be notified via in-app message, email, or website notice. Continued use after updates confirms acceptance; review periodically.

 

11. General Provisions

These Terms are governed by the laws of the State of California, United States of America, excluding its conflict of laws principles. Disputes will be resolved via good-faith negotiation; unresolved disputes shall be submitted to the exclusive jurisdiction of the state and federal courts located in the State of California.

These Terms constitute the entire agreement between you and Elowynthia, superseding prior agreements. Invalid/unenforceable provisions do not affect others; failure to enforce a provision is not a waiver.
